Inspection of Residential Rental Properties
A Resolution on the Inspection of Residential Rental Properties
WHEREAS, the 2003 General Assembly passed a bill, House Bill 748 (HB 748), that
was amended to limit the ability of local governments to perform visual
inspections on residential rental property; and
WHEREAS, Senate Bill 361 (SB 361), was also introduced during the 2003 General
Assembly which would require every government within the state to be bound by
each statute enacted by the General Assembly and by any rule or regulation
adopted unless stated otherwise; and
WHEREAS, SB 361 would clearly violate the intent of home rule and seriously
undermine municipal powers; and
WHEREAS, cities are the government closest and most responsive to the needs of
municipal residents and businesses; and
WHEREAS, the Metro Atlanta Mayors Association is concerned about the unnecessary
erosion of home rule and the ability of cities to enact ordinances and
regulations to protect the health, safety and welfare of municipal residents.
NOW THEREFORE BE IT RESOLVED that Metropolitan Mayors Association (MAMA)
supports the repeal of HB 748 that limits the ability of local governments to
conduct inspections of residential rental property.
BE IT FURTHER RESOLVED that MAMA opposes any legislation that attempts to
restrict the authority of municipalities to provide certain services to their
citizens.
